Terms of Service
Effective date: 18 October 2026. These terms govern your use of the EthicalStrike service.
1. Who we are
EthicalStrike is operated by Approved Systems (ABN 53 637 851 104), Canberra, Australia (“we”, “us”, “our”). By creating an account or using the service you (“you”, “the customer”) agree to these terms.
2. The service
EthicalStrike provides automated network penetration testing and reporting through a sensor you deploy and a portal you access. The service identifies security exposures and, on paid plans, provides remediation guidance.
3. Authorised use only
- You may only test networks and systems that you own or are expressly authorised to assess. You are responsible for holding that authorisation and for defining the scope of each engagement.
- You must not use the service to test, scan or attack any third party without their documented permission.
- You are responsible for activity under your account and for keeping your credentials secure.
4. Free trial and Discovery
We may offer a free trial. A trial may run as a Discovery assessment, which reports what is exposed without detailed remediation guidance; remediation guidance is provided on a paid subscription. We may ask for your payment details during the trial, toward the end of the trial, or when the trial ends, so your service can continue without interruption.
5. Subscriptions, billing and GST
- Paid plans are subscriptions that renew automatically for successive periods (monthly or annual) until cancelled in accordance with these terms.
- Prices are in Australian dollars and exclude GST unless stated; GST is added where applicable.
- Fees are billed in advance for each period using your nominated payment method. The Discovery scan is a one-off charge.
- Resellers who bill their own clients do so through their own payment provider and are responsible for those arrangements.
6. Contract term and cancellation
- Where a plan has a minimum contract term, you commit to that term. You may cancel renewal with notice effective at the end of your current term, unless a minimum term still applies.
- Removing or cancelling your payment method, or stopping payment, during a contract term does not end your contract or your obligation to pay for the remainder of the term.
- If a payment fails or a payment method is withdrawn during a term, we will contact you to arrange an alternative payment method. If the amount owing remains unpaid, we may suspend the service and refer the outstanding debt to a debt collection agency, and you may be liable for reasonable recovery and legal costs permitted by law.
7. Financial hardship
If you are experiencing financial hardship, please contact us as early as possible at hello@ethicalstrike.com.au. Talking to us is always the best approach, and we will work with you in good faith to find a reasonable arrangement. Cancelling, removing a payment method or stopping payment without contacting us is treated as a breach of these terms.
8. Your data and privacy
We handle assessment data and your account information in line with Australian privacy law. Reports and findings are available to you through the portal. We retain data for the period applicable to your plan and delete or de-identify it afterwards in line with our retention practices.
9. Resellers and MSPs
If you sign up as a reseller or MSP, you are responsible for your own clients, for ensuring each client has authorised the testing of their environment, and for your own billing arrangements with those clients. White-label branding you provide must be your own or properly licensed to you.
10. Warranties and liability
Testing identifies exposures that are detectable at the time of assessment; it does not guarantee that a network is free of all vulnerabilities. To the extent permitted by law, our liability is limited to resupplying the service or the fees paid for the relevant period. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
11. Changes and governing law
We may update these terms from time to time; material changes will be notified through the portal or by email. These terms are governed by the laws of the Australian Capital Territory, Australia.
